Warranty terms
Contractor warrants for the life of the original Owner under this Agreement and only for as long as the original buyer owns the pool, that the pool shell shall be structurally sound.
“Structurally Sound” shall mean that the pool is capable of containing and materially holding water up to the normal water level, typically the center of the waterline tile, and in the event of its failure to do so, except as otherwise hereinafter provided in this Swimming Pool Agreement, Contractor shall repair same so that it will be capable of containing and materially holding water.
Damage to the pool structure resulting from acts of third parties, blasting or construction are not included in the scope of this Warranty.
Water loss resulting from chemical erosion or damage to interior finish or grout is not included in this “Structural” warranty.
All of the provisions of the One Year Limited Warranty, the extent not contradictory hereto, shall apply to this Warranty.
The structural warranty defined above is limited to one (1) year for swimming pools constructed for other building contractors for the purpose of resale.
Structural coverage, explained.
This warranty focuses on the pool shell and its ability to contain and materially hold water up to the normal water level, typically the center of the waterline tile.
It applies to the original owner only while the original buyer owns the pool. The warranty sets out exclusions for damage from third parties, blasting or construction, and for water loss resulting from chemical erosion or damage to the interior finish or grout.
